My son has been a car salesman for years and made a good living. With the economic problems, he has really been hurting! Now he is behind on his mortgage and has received a 7 day letter from his mortgage holder. He has already used up his savings. Is there some gov’t program or intervention that can save his home?

I am trying to help a family memebr avoid bankruptcy and her situation is dire . She lives in an area where the real estate market has stalled out . Her primary residence has a huge payment plus two home equity loans . She has a smaller house that she had been renting out just to make payments . The tenants moved out with no notice . Each month she gets deeper into debt . If she were to sell either house she would still be upside down on the loans . She is at a point where she is not able to pay the larger loan . What will happen to the two equity loans if she goes into foreclosure ? Her credit is already pretty well destroyed .

Hi. I have a verbal month to month agreement with my landlord in New York State. She recently stopped paying the mortgage and the house is going to go into foreclosure. I got the paperwork from the attorney handling it back in November. My lanlord states that I have to continue to pay her the rent each month of $400. Is this true? I’ve heard from other sources that I can continue to live in the house with out paying my landlord until the bank gives me a 60 day notice to move.

My wife lost her job 1yr ago and they were starting foreclosure process on our house. She Got another job shortly after. Everything was fine until 3 weeks ago. She got real sick and she was out and then they fired her 4 days ago. They did not pay her anything. Mortgage payment was due today. We don’t live there anymore and are staying with friends in another state. Is their anyway we can avoid foreclosure at all? Or will foreclosure be a good thing? I have no idea what to do. My mom and my step dad have declared bankruptcy one or two times in the last 10 years. My older brother now lives with them because his health hasn’t been so great for some time. Needless to say their credit isn’t so good after filing for bankruptcys. Now I hear the bank has gone to foreclose their home and they say to us, their adult children that they have their lawyer working on it but don’t tell us much else. My parents havent made such great choices about their money in the past so we are pretty skeptical. Not only that a majior reason why they are in this finacial hell is because my step dad fell for an internet e-mail scam. I and my brother am trying to help them as much as we can with our own practical smarts but they haven’t told us any details so far. From what we gather my parents could be housless come Febuary. What can be done to help them legally and, or what would you do about all this?

I have a first and second mortgage (to avoid PMI) and I am wondering if, after foreclosure, if we are going to be liable finacially for the banks loss, or the difference between our loan balance and what they get in the foreclosure sale? I know that our credit score will be affected, but I am wondering if that is the only repercussion? I also know the laws are different in states I am in Nevada anyone that knows the nevada foreclosure law specifically would be great. I am also wondering once we move out, assuming we do so before notice to evict what role will we, as the homeowners, need to play in the foreclosure process? I have heard that you must fill out a 1099 form for taxes? saying the difference between the amount owed and what the bank gets is roughly 30,000 what would that mean we pay at tax time?
