My house went up for a tax sale and someone purchased the certificate. They are about to foreclose. My father is on SS disability and we live in New Jersey. He is half owner of the house which he shares with a brother. The house is paid off except for the taxes. Are there any programs, loans, or any help out there that can save my house?

Knowledge is often the best means to verify qualifications. There are a lot of “stop foreclosure” company’s willing to help people. Good or bad intentions are unknown. If the public will ask a few key questions they can usually tell right away if the source is legitimate or a predator. So here is one I think is very important to know regarding foreclosure.. . take a shot!

I know both are bad on credit, but is the short sale, a teeny bit better, at least? Also, house is not in my name, so my credit won’t be affected… we can use mine in the future to buy a house when we are ready.

It depends on how far along you are in the foreclosure process. First off you need income. Second, communication with your lender is extremely important in the early stages. If you are in the latter stages, you can get a loan reinstatemnet. And lastly you can file chapter 13 bankruptcy even just to delay the foreclosure sale if time is needed to either get the loan reinstated or to find a new place to live. If you do have to move, make sure to negotiate a good cash for keys deal with the lender. They will give you thousands of dollars to move out and leave the property in decent condition within a 30-60 day period.

I am in Denver, CO I need to stall the sale of my property, I have put money in to sell it, many prospects. I just need to buy a little time. The chapter 7 has been filed the Judge granted the Banks motion to release the propert, I never received notice of the motion, what can I do?

if so what do i do if the loan company want stop the sale if there some kind of paper that i can file with the court to stop it? First Franklin is the loan company and they don’t care

Specifically what options can a mortgage company have to get the court to hear a motion to force the hand of one party to sign papers to sell a house. There are two parties involved, but one is dragging their feet. There is no disagreement over the validity of the mortgage or that foreclosure is imminent. The stalling party continues to delay the proceedings by switching attorneys and then being granted a continuance. There is a buyer for the house, but needs the signature of both parties to continue. Given that the financial interest of the mortgage company is clear, can they file a AC brief?
