We recently filed Chapter 13 to avoid foreclosure, but now I am thinking about letting the house go and changing to Chapter 7? We can’t afford the house mtgs, taxes and insurance on our reduced salary. Question – in a chapter 7 can the creditors (?) come in and take stuff from your house? If so, what are they looking for – high ticket items? We do not have any. Husband is afraid they will come in and take all kinds of stuff. I disagree. With all the foreclosures coming down right now, they do not have the time or expense to chase all these down.
What about the 2 cars we are behind on payments on?
Has anyone gone thru this?

Yes there is. You may contact the lender that is doing the foreclosure, tell them you have a vested interest in the property, and you need to know the amount that is owed to them to stop their foreclosure.
They might want proof so you might want to get a copy of your lien from a title company. Faxit to them as soon as possible.
Once you have this information, contact a foreclosure service in your locality, give them the information and they will foreclose on your behalf.
Some charge an up front fee and some don’t, so if you are short of funds you might shop around until you find one that take their fees out on the back end of the foreclosure. They will take over the foreclosure from the previous lender.
It does not matter unless you don’t have the funds because who ever pay for it will get it back if the owner bring the foreclosure current or the house is sold at the bid or sale.
If the house do not sale then you will have to come up with the monthly payment to the mortgage company as well as the foreclosure services fee, but the house is now yours.
I hope this has been of some use to you, good luck.

The owner of the house I’m renting gave me notice that the house is going on foreclosure and terminated my lease. She gave me my deposit back and I stopped paying rent. She wants me to move out. If she’s not gonna own the house anymore, do I have to move out? Can i wait till the foreclosure finishes and the bank tells me to move?

or is it up to the lender. We have been told we qualify for 2 different options by a HUD counselor. Can the bank refuse to cooperate?
We do pay our bills we were set back by Hurricane Ike.
We have contacted the bank, but they are not trying to work with us.

Has anyone thats in the industry ever found a home going into foreclosure that has been dramatically paid down however the owner could no longer pay for it? The reason I ask is I saw on a few websites properties that the only thing owed on them was 80,000-100,000. The market values of the house from its area was over 300,000. Could you offer these people the amount to pay off the loan and a little extra to help them out, and to avoid foreclosure? In turn re-selling the home below market value for quick sales? Any input would be greatly appriciated. Thank you in advance.

Lower your price. Price is king right now, and homes that are priced correctly for the market are selling.

My house was schedule for foreclosure sell on April 18, 2008. I had 10 days (28 April) to file bankruptcy if I wanted to keep my house. The attorney I talked to wanted too much money to help me. What can I do? I am considering “Pro Bono” Services for assistance. I only receive military retirement pay as income.
