My landlord of of my apartment has been in the foreclosure process for months and has given no service to all of the civil summons. Basically he is trying to avoid and run. I have been following the online docket closely and I can not wait to see this scumbag slumlord to lose the building so the bank can come and stuff can actually start getting done around here.
The management has tried to tell us that the bank is coming and no one can explain anything to us, so I would appreciate any explanation very much. Does this filing mean he is getting the building back or what?

We filed chapter 13 the day before the auction date of our home in NY and this did stop the sale. Filing chapter 13 was our only hope. Without a doubt, if our home could have been saved any other way, we would have done so. It’s a scary, nauseating situation to be in. Unfortunately, it’s not over. We still have hearings to appear at and it still has to be confirmed, and mortgage plus trustee payments must be received on time. We’ve had our home on the market since Sept. of ’07 and are naturally praying for a buyer (as we know so are thousands of other people!).
We also pray for you and your family, we wish you strength and patience through all this. God Speed.
P.S. I’d just like to add that we’ve lived in our home for 14 years and came upon financial hardship due to an illness and loss of job.

I know that chapter 12 is for farmland, vs Chap 7, 11, or 13. This is for a school assignment!

I have been out of work and start a new job on monday, but the mortage company says that i cannot make any payments or a 2,000.00 down payment untill i have a job and next month i will but next month it will go up higher and i just dont understand why they will not take any payment now even if i am not working untill next month.

Landlord stopped paying mortgage for like 6 months and stopped foreclosure by filing bankruptcy on the day of the auction, and told us that bout her 3-6 months before she can file file for bankruptcy again, buying more time, CAN WE Leave?
