Can The Owner Of The House In Foreclosure Evict Me If I Stopped Paying Rent? I Dont Have A Lease.?

The owner of the house I’m renting gave me notice that the house is going on foreclosure and terminated my lease. She gave me my deposit back and I stopped paying rent. She wants me to move out. If she’s not gonna own the house anymore, do I have to move out? Can i wait till the foreclosure finishes and the bank tells me to move?

Yes! Until the bank wins the forclosure and gets title ( It take up to 1-2 years ) , your landlord still have the right evict you .
If you don’t have a written lease ,the law ordinarily treats you as having a month to month oral lease.

Yes the owner of the house can have you evicted if you don’t pay to live there. They can take you to court and you will have to pay what you owe plus court costs. It depends on the local court regarding how much time you will be allowed to stay before the sheriff will put your possessions out on the street. You should count yourself lucky that the owner gave the deposit back considering she/he must be in serious difficulties so do the right thing and move.

Lets see – although she is in foreclosure, she still owns the house. Plus, the bank will probally vacate you once they own it because it is easier to sell an empty house sometimes.
Plus – you have no lease. She gave your deposit back (probally thinking it was the fair thing to do). And you are no longer paying to live there. I’m sorry, but you gotta move, probally before the next month’s rent would be due.
You cannot expect to live somewhere for free, regardless of the financial situation of the owner. Take the deposit plus the money you would use for the rent and find a place as soon as possible.

First of all, they had no right to terminate your lease. But, it sounds like you accepted it by receiving your deposit. Just because she’s *going* to lose the house, that doesn’t give you any more rights than if she *wasn’t* going to lose the house, now does it?
Sounds like she was treating you fairly and now you want to take advantage of the situation.
Move.

You can do whatever you want to do. But the question is should you? Think about your own piece of mind. I would move as soon as I could. Why wait? Eventually you are going to have to move. Staying until the home forecloses has very little benefit to anyone in the long run.
Get going and set up shop somewhere else. Don’t add to an already caotic situation.

They are still the owner until the bank takes over. If you are told to leave, then you must leave. They bank will not tell you to move because you are a nobody to them. They are much more likely to have you arrested for squatting.
